Terms of Service

These Terms of Service ("Terms") govern access to and use of Affset (the "Service"), a white-label ad server and CPA network platform operated by Elusione OÜ, a company registered in Estonia ("Affset," "we," "us"). By creating an account, signing in, or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent (your "Account").
If you do not agree to these Terms, do not use the Service. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
1. The Service
Affset provides ad-serving infrastructure for running a white-label CPA (cost-per-action) network: campaign and zone management, targeting, click and conversion tracking, postback delivery to third parties, budgets and payout rules, and reporting. An Account may have multiple users with different roles — owner, manager, publisher, or advertiser — each scoped to what that role needs to see and do.
The Service is infrastructure. What you advertise, which publishers or advertisers you work with, and the commercial terms between you and them are entirely your responsibility and outside Affset's control.
2. Accounts and Access
You are responsible for maintaining the confidentiality of your API keys and any credentials used to access the Service, and for all activity that occurs under your Account. Notify us promptly at support@affset.com if you suspect a key has been compromised — a leaked key lets whoever holds it act as your Account, including reading traffic data and changing campaign or payout settings.
You must provide accurate account information (including a working email address, since it is used for sign-in and for account, billing, and security notices) and keep it up to date.
3. Plans and Billing
Affset is offered on subscription plans (including a Free plan with usage limits) billed monthly or annually. Some plans bill overage beyond included usage; others have a hard usage cap instead. Current plan details and limits are published on our pricing page and may change with notice.
Paid plans are billed in advance via our payment processor. By subscribing, you authorize recurring charges to your payment method until you downgrade or cancel. Fees are non-refundable except where required by law or stated otherwise at the time of purchase.
If a payment fails or an Account exceeds its plan's usage limits, we may, depending on your plan, throttle service, suspend ad serving, or downgrade the Account after notice. We are not responsible for traffic loss or revenue loss resulting from a suspension caused by non-payment or a limit breach.
4. Acceptable Use
You may use the Service to run and monetize a broad range of lawful advertising and affiliate marketing verticals. You are responsible for ensuring that campaigns, creatives, landing pages, and offers run through your Account comply with the advertising, consumer protection, and disclosure laws of every jurisdiction you target.
You may not use the Service to:
- Distribute malware, exploit code, or content designed to compromise a device or account;
- Run phishing, credential-harvesting, or other schemes intended to deceive end users into disclosing sensitive information;
- Generate, purchase, or route fraudulent clicks, impressions, or conversions (including bots or incentivized traffic misrepresented as organic);
- Advertise anything illegal in a jurisdiction you're targeting, including counterfeit goods, unlicensed pharmaceuticals, or content exploiting minors;
- Circumvent rate limits, namespace isolation, or other technical restrictions of the Service, or access another tenant's data without authorization;
- Probe, scan, or test the security of the Service without our prior written consent.
We may suspend or terminate an Account that violates this section, with or without notice depending on severity.
5. Publishers, Advertisers, and Postbacks
Affset lets you record conversions and forward postback notifications (with click and payout data) to URLs you configure, and lets your zones receive click macros (such as a source click ID or cost value) from the traffic sources you configure. You are responsible for the accuracy of the postback URLs and macros you set up, for any agreements you have with the publishers and advertisers you route through the Service, and for paying out amounts you owe them — Affset only provides the tracking and reporting infrastructure, it is not a party to those agreements and does not hold or transmit funds between you and your publishers or advertisers.
6. White-Label Use
Paid plans that include a custom domain or branded dashboard grant you a limited, non-exclusive, non-transferable license to present the Service under your own branding on the domains you configure, for as long as your subscription remains active. This license does not transfer ownership of the underlying Service, software, or Affset's trademarks.
7. Data and Tracking
Our Privacy Policy describes what data the Service processes and how. Ad-serving and click/conversion tracking on the Service is cookieless — attribution runs on URL-based click identifiers rather than browser cookies. Where your own use of the Service (for example, targeting rules or analytics you configure) involves processing personal data of your own end users, publishers, or advertisers, you are responsible for having a lawful basis to do so and for your own disclosures to them.
8. Service Availability and Changes
We aim for high availability but do not guarantee uninterrupted or error-free service, except where a separate Enterprise agreement states an SLA. We may modify, add, or remove features, and may change these Terms, with notice as described in Section 14.
9. Intellectual Property
You retain all rights to the campaigns, creatives, and content you upload or configure. You grant Affset a limited license to host, process, and transmit that content solely to operate the Service for you. Affset and its licensors retain all rights to the Service itself, including its software, design, and trademarks.
10. Termination
You may stop using the Service and close your Account at any time. We may suspend or terminate an Account for breach of these Terms, non-payment, legal or security reasons, or extended inactivity, with notice where practical. On termination, your right to access the Service ends; data is retained and deleted according to the retention terms described in our Privacy Policy.
11. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFFSET WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST TRAFFIC, ARISING FROM YOUR USE OF THE SERVICE. AFFSET'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You will indemnify and hold Affset harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service in violation of these Terms, your campaigns or content, or your relationships with your own publishers or advertisers.
13. Governing Law
These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles. Any dispute not subject to a separate arbitration or venue agreement will be brought in the courts of Estonia.
14. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide notice (such as an email to your Account's contact address or a notice in the dashboard) before the change takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
